La observancia de los principios de igualdad de oportunidades y de mérito en el acceso al servicio civil

This article explores the principles of equal opportunities and merit in the field of access to
the civil service, questioning the forms of concretion or materialization of said principles, as well as the situations that contravene such principles. For this purpose, using a diverse
bibliographic compilation, the difference in access to public employment and access to private
employment is analyzed, as well as the reasons that justify these differences. The relationship
between the right to access a public office and the principle of equal opportunities as a material
presupposition of said right is also analyzed; likewise, the incidence of the principle of equal
opportunities in the elaboration of the rules that govern the public tender and in the actions
of the authorities in charge of said tender is developed. On the other hand, the principle of
merit is analyzed as a fundamental factor in access to public employment, and as a pivotal
criterion in the evaluations made to applicants. Finally, conclusions are made on the main
aspects of the topics addressed.
