Abstract

This article examines the feasibility of incorporating mediation mechanisms into procedures for access to public information in Peru, using the experience of Catalonia as a reference. The aim is to assess the legal and institutional viability of an administrative mediation model that would allow conflicts between citizens and public entities to be managed in a more dialogic, efficient, and transparent manner.

The methodology employed is comparative and dogmatic, based on a documentary analysis of Peruvian and Catalan legislation and public reports. The findings show that the Peruvian system maintains an adversarial and formalistic procedure, whereas the Catalan model incorporates mediation spaces that facilitate agreements and reduce administrative conflict.

Based on this contrast, the article argues that mediation could be integrated in Peru as a voluntary stage prior to the resolution of appeals before the Transparency and Access to Public Information Tribunal. The article proposes regulatory and institutional guidelines aimed at strengthening a culture of transparency through the adoption of collaborative mechanisms in public administration.
